Welcome to ChillArt. These Terms of Service (“Terms”) govern your access to and use of the ChillArt website, apps, and services (collectively, the “Platform”). By accessing or using ChillArt, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Platform.

We may update these Terms from time to time. Continued use of ChillArt after changes means you accept the updated Terms.

Acceptance of Terms

By using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you are using ChillArt on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

Important: ChillArt is a neutral hosting platform for user-generated content. We do not create, endorse, or guarantee any user content. You use the Platform at your own risk.

User Accounts

You may need an account to access certain features. You agree to:

  • Provide accurate and up-to-date information
  • Keep your login credentials confidential
  • Be responsible for all activity under your account
  • Notify us of suspected unauthorized use

Warning: You may not sell, transfer, or share your account, or use another user’s account without permission.

User Content, Responsibility, and Rules

The Platform lets users upload, publish, and share content including artwork, images, text, and comments (“User Content”). You are solely responsible for your User Content and your actions on the Platform.

Your responsibilities:

  • You own the User Content you post, or you have all rights and permissions to post it
  • Your User Content does not violate copyright, trademark, privacy, publicity, or any other rights
  • Your User Content complies with all applicable laws and these Terms

Prohibited content and behavior (non-exhaustive):

  • Copyrighted material posted without permission
  • Adult sexual content / pornography / explicit nudity
  • Real gore or extreme violence content
  • Harassment, hate speech, threats, doxxing, or discrimination
  • Spam, scams, phishing, malware, or attempts to bypass security
  • Impersonation, fraud, or misleading identity
  • Any illegal activity or content that facilitates wrongdoing

ChillArt may remove, restrict, or disable access to User Content at any time. We are not obligated to monitor content, and our moderation does not make us responsible for User Content.

Platform liability: You understand that ChillArt is not responsible for User Content or user conduct. If you see content that violates these Terms, please report it.

Intellectual Property and License

You retain ownership of your User Content. However, to operate the Platform, you grant ChillArt a limited license.

Your license to ChillArt:

  • You grant ChillArt a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, distribute, and promote your User Content on the Platform
  • This license is solely for operating and improving ChillArt (including showcasing content in feeds, search, categories, and promotions)
  • The license ends when you delete your User Content, except for copies required for legal, security, or backup purposes for a reasonable period

ChillArt intellectual property:

  • ChillArt owns the Platform software, branding, design, logos, and all non-user content
  • You may not copy, reverse engineer, or misuse our branding or code without permission

Copyright complaints: If you believe your work is infringed, contact us at [email protected] with proof of ownership and the URL(s) in question. We may remove content and may ban repeat infringers.

User Conduct and Safety

You agree to use ChillArt respectfully and lawfully. You must not:

  • Violate any laws or third-party rights
  • Harass, threaten, or abuse other users
  • Attempt to access accounts, servers, or systems without authorization
  • Scrape or mass-download content except where explicitly allowed
  • Interfere with the Platform’s normal operation

We may take enforcement action including warnings, content removal, feature restrictions, suspension, or permanent bans.

Privacy and Data Protection

Our Privacy Policy explains how we collect and use data. By using ChillArt, you agree to that policy.

  • We may collect technical data such as IP address, device/browser data, and cookies for security and performance
  • We do not sell personal data
  • Users in Morocco, the EU, and the US may have specific legal rights depending on jurisdiction

Public sharing: Content you post may be public. ChillArt is not responsible for how other users or third parties use public content.

Payments and Premium Features

ChillArt may offer paid features in the future. If we do, additional terms may apply and will be displayed before purchase.

  • Payments may be processed by third-party providers
  • Pricing, billing cycles, and cancellation terms will be disclosed at checkout
  • We may change or discontinue paid features at any time, subject to applicable law

If you are not using premium features, this section may not apply to you.

Termination and Enforcement

We may suspend or terminate your access at any time if we believe you violated these Terms, created risk, or for legal or security reasons.

  • We may remove or restrict User Content
  • Repeat infringers or serious violations may be permanently banned
  • You may stop using ChillArt at any time

Some sections (including intellectual property, disclaimers, limitation of liability, and indemnity) survive termination.

Disclaimers and Limitation of Liability

ChillArt is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind. We do not guarantee uninterrupted service, error-free operation, or that content will always be available.

To the maximum extent permitted by applicable law, ChillArt is not liable for:

  • User Content or user conduct
  • Copyright or other disputes between users and third parties
  • Loss of data, profits, revenue, or business opportunities
  • Security incidents, downtime, or service interruptions
  • Third-party links, services, or integrations

Cap on liability: To the extent allowed by law, ChillArt’s total liability for any claim is limited to the amount you paid to ChillArt in the 12 months before the event giving rise to the claim (or $10 USD if you paid nothing).

Legal Terms (Morocco / EU / US), Indemnity, and Changes

Platform neutrality: ChillArt is a neutral hosting provider for user-generated content and is not the publisher of User Content. Where applicable, ChillArt relies on intermediary liability protections such as: EU eCommerce Directive / DSA principles, US 47 U.S.C. §230, and similar protections under Moroccan law.

DMCA-style notices (US): For US-related complaints, ChillArt may follow DMCA safe-harbor processes (17 U.S.C. §512).

Indemnity: You agree to defend, indemnify, and hold harmless ChillArt and its team from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your User Content or your violation of these Terms.

Changes: We may update these Terms at any time. If changes are material, we may provide notice. Continued use means acceptance.

Local law: You are responsible for complying with the laws that apply to you. ChillArt disclaims responsibility for unlawful use by users in any jurisdiction.
